1. Introduction
Welcome to VuKart ("we," "us," or "VuKart"), a multi-service platform facilitating taxi services, food delivery, parcel delivery, e-commerce, and other services via our app and website (https://www.vanuatu-kart.com) (collectively, the "Platform"). These Terms and Conditions ("Terms") govern your use of the Platform as a consumer ("User") or service provider ("Provider") such as a driver, restaurant, or merchant.
2. Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy (https://www.vanuatu-kart.com/privacy/policy). If you do not agree, do not use the Platform.
3. Eligibility
You must be at least 18 years old to use the Platform. By using the Platform, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account Registration
- Users: You must register an account to access certain features (e.g., ordering services). Provide accurate information and keep your account credentials secure.
- Providers: You must provide business details, licenses, and payment information for verification. VuKart may conduct KYC or fraud checks before approving Provider accounts.
- You are responsible for all activities under your account.
5. Platform Services
VuKart connects Users with Providers for:
- Taxi services (e.g., ride-hailing).
- Food delivery from restaurants.
- Parcel delivery.
- E-commerce purchases from merchants.
- Other services as available.
We act as an intermediary and are not responsible for the quality or performance of Provider services.
6. User Responsibilities
- Provide accurate order and payment information.
- Comply with all applicable laws and regulations.
- Treat Providers respectfully and follow safety guidelines (e.g., during taxi rides or deliveries).
- Report issues promptly via contact@vanuatu-kart.com.
7. Provider Responsibilities
- Provide accurate service and business information.
- Deliver services in a professional, timely manner.
- Comply with all applicable laws, licenses, and regulations (e.g., driver permits, food safety standards).
- Maintain accurate pricing and availability on the Platform.
8. Payments and Fees
- Users: You agree to pay for services ordered, including applicable fees (e.g., delivery charges, taxes). Payments are processed via third-party providers (e.g., Stripe).
- Providers: You receive payments for services minus Platform fees, as agreed. Payments are processed to your designated bank account.
- Refunds or disputes are handled per VuKart’s policies, available on request.
9. Intellectual Property
All content on the Platform (e.g., logos, text, designs) is owned by VuKart or its licensors. You may not reproduce, distribute, or use this content without permission, except for personal, non-commercial use.
10. Prohibited Conduct
You may not:
- Use the Platform for illegal activities.
- Post false, misleading, or harmful content.
- Interfere with the Platform’s functionality (e.g., hacking, spreading malware).
- Harass or harm other Users or Providers.
- Misrepresent your identity or business.
11. Termination
We may suspend or terminate your account for violating these Terms, with or without notice. You may delete your account by contacting contact@vanuatu-kart.com.
12. Limitation of Liability
To the extent permitted by law, VuKart is not liable for:
- Losses arising from Provider services or User actions.
- Indirect, incidental, or consequential damages.
- Platform interruptions or data loss.
Our total liability is limited to the amount you paid for services in the preceding 12 months.
13. Indemnification
You agree to indemnify VuKart, its affiliates, and partners from claims, losses, or damages arising from your use of the Platform or violation of these Terms.
14. Governing Law
These Terms are governed by the laws of Vanuatu, without regard to conflict of law principles.
15. Dispute Resolution
Any disputes arising from these Terms or Platform use will be resolved through negotiation. If unresolved, disputes will be submitted to binding arbitration in Vanuatu, conducted by a mutually agreed arbitrator.
16. Changes to These Terms
We may update these Terms to reflect legal or operational changes. Updates will be posted on https://www.vanuatu-kart.com/pages/terms, and significant changes will be communicated via the Platform or email.
